China OPC for Foreigners: Can a Foreigner Start a One-Person Company in China?
A foreigner can establish a company alone in China where the proposed business is permitted under foreign-investment rules. But “OPC” in current AI policy is not a separate national company type or an automatic foreign-founder support package. A single-shareholder limited liability company, an AI-assisted operating model and admission to a local OPC programme are three different questions.

What company law allows
China’s Company Law allows a limited liability company with one to fifty shareholders. The Foreign Investment Law expressly includes investment by foreign investors alone or jointly. The combination supports a single-owner foreign-invested company in an eligible business; it does not remove restricted-sector conditions or licensing requirements.
Describe the activity precisely: a software product, regulated online service, research operation and manufacturing business are not interchangeable registration cases. Check the current negative list and the relevant sector rules against that description before commissioning incorporation.

What “OPC” adds — and what it does not
Beijing’s 2026 AI OPC action plan concerns small AI-enabled businesses and supporting communities. Its resource and ecosystem measures sit alongside the ordinary company framework. They do not replace the business licence, create a universal foreign-founder category or settle an individual application.
A company may have one shareholder but employ several people. A founder using AI agents may still have co-founders, contractors or an existing overseas company. Decide which meaning of “one person” a page or provider is using before comparing offers.

Verification required
Can a foreign-owned company receive support?
Equal treatment of foreign-invested enterprises is the national baseline, including in relevant support-policy processes. That is different from proving that a particular business satisfies a district programme’s conditions. The official OPC materials reviewed here do not establish blanket foreign-founder admission.
Ask the programme or competent authority about the proposed ownership, operating activity, local presence and current application channel. Request a response that identifies the actual measure and batch. A general welcome from a community is useful context, but it should not be treated as approval of funding, work permission or every service advertised.

Decision guidance
Does the project need a Chinese company now?
Begin with what China would do for the business. A supplier relationship, manufacturing pilot, research discussion or market-validation project may have a different implementation sequence from a local employing and contracting operation. “Interested in China” is not itself an incorporation brief.
Write down the first deliverable, who must contract and invoice, where work happens, what data or intellectual property moves, and who must be physically present. Those facts make professional legal, tax and regulatory advice specific enough to use. They also reveal whether an OPC community solves a real operational problem or simply looks attractive in a search result.

A useful first decision sequence
Keep three decisions separate: business fit, location fit and implementation. A positive answer to one does not settle the others. If the project needs China manufacturing but no regular Beijing activity, a Beijing policy headline should not dictate the structure.
- Define the China function and a small, testable first milestone.
- Compare the relevant city and ecosystem against that function.
- Check ownership and activity restrictions, then personal work and residence requirements if relevant.
- Verify a named programme’s current conditions before including support in the budget.
- Purchase downstream setup services against a defined operating brief.
